3. Eligibility
You must be at least 18 years old to purchase goods or services through this website.
Certain events are strictly 18+ where alcohol is permitted or provided. These events will be clearly marked as 18+.
Some events may be suitable for attendees aged 12 to 17 only where explicitly stated. In such cases, attendees under 18 must be accompanied at all times by a parent or legal guardian who assumes full responsibility for them throughout the event.
Where age restrictions apply, we reserve the right to refuse entry or participation if suitable identification or supervision requirements are not met.
4. Orders and contract formation
Service Fees
A service fee may be added to your order or booking total. Any applicable fees will be displayed before payment is completed.
When you place an order or booking, you will receive an acknowledgement email.
This does not constitute acceptance of your order.
A contract is formed only when we confirm acceptance or dispatch (for physical goods), or confirm your booking (for events, where applicable).
We reserve the right to refuse or cancel orders before acceptance for reasons including pricing errors, availability issues, or suspected fraud.
5. Pricing and payment
All prices are shown in GBP (£).
Payment is required in full at the time of purchase unless otherwise stated.
We use secure third-party payment providers such as Wix Payments and PayPal. We do not store full payment card details.
We reserve the right to update pricing at any time. Changes will not affect confirmed orders.
6. Shipping and delivery (physical products only)
We aim to dispatch orders within the stated timeframes shown on product pages.
Delivery times may vary depending on location and carrier.
Risk of loss or damage passes to you upon delivery.
We are not responsible for delays caused by carriers or events outside our control.
7. Returns and refunds
You have the right to cancel most physical product orders within 14 days of receiving them.
To request a return, contact us at the email above with your order details.
Returned items must be in original condition.
Refunds will be processed within 14 days of receiving returned goods.
The right to cancel does not apply to:
-
Custom or personalised items
-
Digital downloads once accessed or delivered
Return shipping costs are the responsibility of the customer unless the item is faulty.
8. Events and Experiences
The following terms apply to all workshops, Paint & Pour sessions, exhibitions, demonstrations, and other in-person or virtual events organised by The Painless Artist.
8.1 Bookings and Attendance
A booking is confirmed once payment has been successfully received and a booking confirmation has been issued.
Attendees are responsible for ensuring that the information provided during booking is accurate and up to date.
We reserve the right to refuse bookings or attendance where we reasonably believe doing so is necessary for the safety, comfort, or enjoyment of attendees, staff, venue personnel, or the public.
8.2 Customer Cancellations
Unless otherwise stated, tickets and event bookings are non-refundable.
If an event is cancelled by us, the venue provider, or a key third-party supplier whose services are necessary for the event to proceed, we may offer either a full refund, a transfer to a rescheduled event, or a credit towards a future event.
Where you are unable to attend, you may contact us to discuss transferring your booking to another person or another event date. Any such transfer is entirely at our discretion and cannot be guaranteed.
Nothing in these Terms affects any statutory rights you may have under applicable consumer protection laws.
8.3 Event Cancellation or Changes
We reserve the right to cancel, postpone, reschedule, relocate, substitute instructors, or make reasonable changes to any event where necessary.
Reasons may include, but are not limited to, illness, venue issues, adverse weather conditions, insufficient attendance, safety concerns, or circumstances beyond our reasonable control.
Where we cancel an event, attendees will be offered either:
-
A full refund; or
-
A transfer to an alternative event, where available.
Minor changes shall not entitle attendees to a refund.
8.4 Late Arrivals
Events will begin at the advertised start time.
Late arrival may result in missing parts of the session. We are not obliged to extend sessions or provide additional instruction due to late attendance.
Where venue restrictions apply, late entry may be refused.
8.5 Behaviour and Conduct
All attendees are expected to behave respectfully towards other attendees, venue staff, instructors, artwork, equipment, and property.
We reserve the right to remove any attendee without refund where their behaviour is:
-
Disruptive;
-
Aggressive;
-
Threatening;
-
Harassing;
-
Intoxicated to an unreasonable degree; or
-
Likely to negatively impact the experience of others.
Any costs arising from such removal shall remain the responsibility of the attendee.
8.6 Alcohol Consumption
Certain events may be designated as 18+ due to the availability, provision, or permitted consumption of alcohol. These events will be clearly identified in advance.
Alcohol consumption is strictly limited to attendees aged 18 and over. Valid proof of age may be requested at any time. We reserve the right to refuse service, entry, or participation where acceptable identification is not provided.
Where BYOB (bring your own alcohol) is permitted, this will be explicitly stated in the event details. BYOB is permitted only for attendees aged 18 and over. Alcohol brought to the event must be for personal consumption unless otherwise stated. Any sharing of alcohol is at the discretion and responsibility of consenting adults aged 18 and over.
Attendees aged 12 to 17 may only attend events where explicitly permitted and must be accompanied at all times by a parent or legal guardian. Minors are not permitted to consume alcohol under any circumstances.
Attendees are solely responsible for complying with all applicable laws relating to the purchase, possession, transport, and consumption of alcohol.
We reserve the right to refuse entry, service, or continued participation to any individual who appears intoxicated, is behaving in a disruptive or unsafe manner, or is otherwise deemed unfit to participate.
We accept no liability for any loss, injury, damage, or consequence arising from alcohol consumption at the event, except where such liability cannot be excluded under UK law.
8.7 Allergies, Dietary Requirements and Food Safety
Food, snacks, and beverages provided at events may be purchased from third-party retailers, suppliers, or manufacturers.
While ingredient information may be available, we cannot guarantee that any item is free from allergens, traces of allergens, or cross-contamination.
Attendees with allergies, intolerances, coeliac disease, medical dietary requirements, or similar conditions are responsible for reviewing ingredient information before consumption.
We are committed to making reasonable adjustments where practical. Attendees requiring specific dietary accommodations should notify us before the event. While reasonable efforts will be made to accommodate requests, we cannot guarantee that all requirements can be met.
Consumption of any food or beverage provided at an event is undertaken at the attendee's own discretion.
Nothing in this section excludes liability where such exclusion would be unlawful.
8.8 Health and Safety
Attendees must follow all reasonable instructions provided by The Painless Artist, event staff, instructors, venue representatives, or emergency personnel.
Attendees participate at their own discretion and are responsible for determining whether participation is suitable for them. We reserve the right to remove any attendee who fails to comply with health and safety requirements.
Paints, brushes, canvases, tools, glassware, and other equipment may be provided during events for use during the session only.
All such equipment remains the property of The Painless Artist or the relevant supplier (where applicable) and must not be removed from the venue or taken home after the event unless expressly stated otherwise.
Attendees may be held responsible for any loss, damage, or unauthorised removal of equipment.
8.9 Art Materials and Equipment
Paints, brushes, canvases, tools, glassware, and other equipment may be provided during events for use during the session only.
All equipment remains the property of The Painless Artist or the relevant supplier (where applicable) and must not be removed from the venue or taken home unless expressly stated otherwise.
Attendees are responsible for the proper and careful use of all materials and equipment in accordance with any instructions provided.
Attendees may be charged for the full replacement cost of any equipment that is lost, damaged, or removed without authorisation.
We are not responsible for damage to clothing, personal belongings, or property arising from normal participation in the event. Attendees are advised to wear suitable clothing.
8.10 Damage to Property
Attendees may be held responsible for any loss, damage, or expense resulting from deliberate, reckless, negligent, or unlawful conduct that causes damage to venue property, equipment, artwork, furnishings, or the property of other attendees.
8.11 Personal Belongings
Attendees remain responsible for their personal belongings at all times.
The Painless Artist accepts no responsibility for loss, theft, or damage to personal property except where required by law.
8.12 Photography and Promotional Material
Photographs and video recordings may be taken during events for promotional, marketing, educational, documentary, or social media purposes.
By attending an event, attendees acknowledge that photography and video recording may take place and consent to the use of images or recordings featuring them by The Painless Artist without compensation.
Attendees who do not wish to appear in photographs or recordings should notify us before the event begins, and we will make reasonable efforts to accommodate their request. However, we cannot guarantee that attendees will not appear incidentally in background footage or photographs.
Where attendees under the age of 18 are present, The Painless Artist does not knowingly publish photographs or video recordings that clearly identify minors without appropriate consent from a parent, legal guardian, or other person with parental responsibility. Reasonable steps will be taken to avoid the publication of identifiable images of minors where such consent has not been obtained.
Nothing in this section obliges The Painless Artist to use, publish, retain, or distribute any photograph or recording taken during an event.
8.13 Accessibility and Reasonable Adjustments
We are committed to making reasonable adjustments for attendees with disabilities, accessibility requirements, or other relevant needs where practical.
Requests for adjustments should be made as early as possible before the event to allow sufficient time for consideration and implementation.
While every reasonable effort will be made, not all requests may be capable of being accommodated due to venue, safety, operational, or practical limitations.
